NATURE OF THE CASE: Erie (D) appealed from Appellate Division of the Supreme Court unanimously affirming judgment in favor International (P)s favor entered upon directed verdict, in P's action seeking to recover insurance proceeds based on D's negligent misrepresentations with respect to where it stored P's goods.
FACTS: International Products (P) was expecting a valuable shipment and made arrangements with Erie R.R. Co. (D) to receive and store the shipment. P inquired where D was going to store the goods; P wanted to insure them. D replied that the goods were at docked at Dock F, Weehawken. The goods arrived later and were stored at Dock D. They were destroyed by fire and P was unable to collect the insurance because of the misdescription. P sued and received judgment from the trial court. The appellate court affirmed that judgment. D appealed.
