NATURE OF THE CASE: Peters (D), police officer, challenged the decision of the District Court, which awarded punitive damages to Kemezy (P) in P's 42 U.S.C.S. 1983 suit against D for excessive force.
FACTS: Kemezy (P) sued Peters (D), an Indiana policeman, under 42 U.S.C. Section 1983 claiming that D had wantonly beat P with an officer's nightstick in an altercation at a bowling alley. D was moonlighting as a security guard at the time. The jury gave P $10,000 in compensatory damages and $20,000 in punitive damages. D appealed.
