NATURE OF THE CASE: McMillan (P) disputed the use of race based statistics to lower his life expectancy for the purposes of damages from a ferryboat crash.
FACTS: P was rendered a quadriplegic from a ferryboat operated negligently by the City (D). P was African American and statistical evidence was introduced to show that P, as a spinal cord injured African American was more likely to survive for fewer years than people of other races. P disputed the introduction of such evidence.
