NATURE OF THE CASE: This was a dispute over misrepresentation. Freeman (D) appealed a
verdict for Pasley (P).
FACTS: Pasley (Ps) were merchants that asked D for a credit reference on Falch before
selling him goods on credit. D lied to Ps about D's credit and Ps then shipped the goods to
Falch who never paid for them. Ps then sued D for misrepresentation. P got the verdict and D
appealed.
