NATURE OF THE CASE: Reed (P) appealed a summary judgment based on a Recreational Use
Statute.
FACTS: Reed (P) and Gimber (D) were members of a Hunting Club (Club) that leased a tract
of land owned by International Paper Company. D was the Club treasurer and signed the lease
on behalf of the Club. Reed (P) climbed into a movable tree stand that had been installed by
Dr. The tree stand collapsed beneath him and caused him to fall to the ground. P sued D and
his insurer, Employer's Mutual (D), for his personal injuries. Ds asserted immunity under a
Recreational Use Statute and moved for summary judgment. The trial court granted the motions
P appealed.
