NATURE OF THE CASE: This was a suit over negligent infliction of emotional harm.
FACTS: The deceased was looking out the window of her house watching her child cross the highway and witnessed the negligent killing of her child by D. The deceased mother was not in the zone of danger for physical impact. D demurred and it was sustained. The appeals court reversed.
