WILKINSON V. POWE

NATURE OF THE CASE: This was an interference with business relations suit.
FACTS: Wilkinson (P) sued D charging them with wrongfully procuring a breach of P's
contract with certain farmers to haul milk. P had a milk hauling business that was
eventually evidenced by a written contract. D approached P and told P that he wanted to take
over the larger route and offered the trade in value of a truck and a job in D's creamery. P
refused to give up the route and informed D of the written contract. Friction then developed
between P and D and D eventually wrote farmers doing business with P a letter that they
would no longer do business with them unless they had the milk picked up by D's trucks only.
P was forced to abandon his routes and P sued D. P got the verdict and a new trial was
granted. On that trial, a directed verdict was issued.
