NATURE OF THE CASE: This was an appeal from a summary dismissal of battery action.
Wishnatsky (P), paralegal, appealed a summary judgment dismissing his battery action against
Huey (D), assistant state attorney general.
FACTS: Huey (D) was an assistant attorney general who was engaged in a conversation with
Crary, attorney at law, in Crary's office. Without knocking or announcing his entry,
Wishnatsky (P) attempted to enter Crary's office. D pushed the door closed pushing P back
into the hall. P then reentered the office and D left. P then sued D for battery. D moved
for summary judgment of dismissal and it was granted. P appealed.
