STATE V. COOPER

529 P.2d 231 (Ariz. 1974)

NATURE OF THE CASE: This was an appeal from a conviction of kidnapping and assault with a deadly weapon.

FACTS: Cooper (D) was intoxicated on amphetamines for several days. D was then pursued by the police for reckless driving. D shot and wounded a pursuing officer and kidnapped a man at gunpoint in a parking lot. D was arrested. D raised the insanity defense at his trial and presented testimony of a psychologist and psychiatrist about his mental condition at the time of the crime. Both witnesses testified that D was insane under the M'Naghten Test for insanity that was used by the jurisdiction. The trial court refused to admit the issue of insanity to the jury. D was convicted. D appealed.
