NATURE OF THE CASE: This was a dispute over Sunday Blue Laws.

FACTS: Ds are employees of a large discount department store that were indicted for the Sunday sale of a binder, a can of floor wax, a stapler and staples and a toy submarine in violation of Maryland Code Art. 27 Section 521. The statute forbids the Sunday sale of all items other than those excepted. Ds contend that this is a violation of the Establishment Clause.
