NATURE OF THE CASE: This was an appeal of larceny conviction.

FACTS: Cummins (D) informed Sweet of his desire to sell a sow and some pigs which were nearby. Sweet paid D $7 and took the pigs. The pigs did not belong to D. D was convicted of larceny of the pigs. D appealed: he never carried away the pigs.
