NATURE OF THE CASE: This was an appeal from a conviction for assault with a deadly weapon and burglary.

FACTS: While visiting a friend, Gauze (D) and his roommate engaged in a terrible quarrel. D's roommate went to their home, and D borrowed a gun. D entered his apartment and shot his roommate in the side and the arm. D was convicted of assault with a deadly weapon and burglary. D appealed.
