NATURE OF THE CASE: This was an appeal from a conviction for smuggling cattle.
FACTS: D was convicted of smuggling 40 head of cattle into the U.S. from Mexico. The trial judge gave an instruction to look to D's personal interest in the suit or its result and because of that deep personal interest he told the jury that this interest should be considered in weighing the evidence that D testified to when he took the stand. D was convicted and appealed.
