NATURE OF THE CASE: This was an appeal from a burglary conviction.
FACTS: The Neffs (D) broke into a chicken house at night and stole some chickens. The owner lived in a house that was set back 75 feet across a public road from the chicken house. The burglary statute in the state included any 'outhouse adjoining thereto (the dwelling house) or occupied therewith.' D were convicted of burglary under the state statute. They appealed.
