NATURE OF THE CASE: This was an appeal from a conviction for burglary.

FACTS: Woods (D) broke into a house with the intent to commit a burglary. The house had never been occupied because it had recently been erected. D was indicted and convicted of burglary. D appealed: the required element of entry into a dwelling house was not established.
