NATURE OF THE CASE: This was a libel action instituted by a public figure. Medico (P) appealed from the judgment, which granted Time's (D) motion for summary judgment in P's defamation suit based on the publication by the news magazine of a summary of Federal Bureau of Investigation (FBI) documents that identified him as a member of an organized crime family.
FACTS: A Time magazine (D) article stated that congressman Daniel Flood steered government business to Medico Industries (P), which Rackets Boss Russell Bufalino frequented. P sued for defamation.
