NATURE OF THE CASE: Board (D) appealed adverse decisions for Jews (P) holding that D's resolution banning all First Amendment activities was facially unconstitutional under the United States Constitution.
FACTS: The Airport Commissioners (D) banned all first amendment activities at LAX airport. Jews for Jesus, Inc. (P), is a nonprofit religious corporation. Snyder, a minister of P, was stopped by a Department of Airports peace officer while distributing free religious literature on a pedestrian walkway in the terminal area at LAX. The Board of LAX (D) adopted a resolution to prohibit all First Amendment Activities, and P's activities violated that resolution. The officer requested P to leave. P was threatened with legal action if he refused to leave as requested. P left and then filed an action challenging the constitutionality of the resolution under both the California and Federal Constitutions. P prevailed and the Supreme Court granted certiorari.
