FACTS: D rented property to P for 12 years knowing that P required a serene and tranquil
environment for its spa business. D rented the space above P to the Hair Cuttery and the
serene and tranquil environment was destroyed by construction noise and eventually the
customers of the Cuttery. P sued D for breach of the covenant of quite enjoyment by
constructive eviction.
