NATURE OF THE CASE: This was a habeas corpus proceeding to determine extradition.
FACTS: The Governor of Tennessee had requested that Hyatt (P) be extradited from New York because he had been indicted for the crime of false pretenses and was a fugitive from justice from Tennessee. There was no evidence that D committed the crime in Tennessee. D was only in Tennessee for one day eight days after the alleged crime was committed and then he left. D was present for purely business purposes; he had never been in the state. D's writ of habeas corpus was granted by New York's highest court. The state appealed.
