NATURE OF THE CASE: This was a dispute over a landlord's refusal to rent.
FACTS: Pierce, made a complaint against Stahl (D) for its refusal to rent an apartment to her because of her race, sex and marital status. D opposed the motion to enjoin the rental of the apartment in question with the fact that 30% of his apartments were rented to blacks including the two most recent wherein there was both black and white applicants. D claimed that the reason for Pierce being rejected was because D thought she would be a source of trouble as a tenant as Pierce was a lawyer.
