NATURE OF THE CASE: This was a dispute over the proceeds of fill sold from land under
contract.
FACTS: The seller entered into a contract for the sale of his land. After the sale and
before closing the seller sold fill from the land for $240,000. The buyer sued and the trial
court computed damages on a per acre removal cost resulting in a reduction of the sales
price of $122,067. The buyer appealed.
