NATURE OF THE CASE: This was a property dispute in a divorce action.
FACTS: H and W separated in June 1983. A final order dividing property was not entered
until August 1987. H and W held the family residence as community property and as tenants in
common after the dissolution. H contends that he was constructively ousted from the family
home and that entitled him to half of the reasonable rental value of the home.
