NATURE OF THE CASE: This was an appeal from a statutory rape conviction.
FACTS: Cash (D) was 30 and picked up a runaway girl who was 15 years and 11 months. She
told D that she was 17. They engaged in sexual intercourse. D was charged with statutory
rape. D sought a jury instruction about his good faith belief in her age. That was denied. D
was convicted and appealed.
