STATE V. BROADHURST
184 Or. 178,196 P.2d 407 (1948)
NATURE OF THE CASE: This was an appeal from a conviction for murder.
FACTS: Mrs. Broadhurst (D) and Williams conspired to kill Dr. Broadhurst. Williams struck
Dr. Broadhurst over the head with a heavy wrench and then decided not to go through with the
killing. He walked back to his own car and was attacked by the doctor. Williams was forced
to kill the doctor in self-defense. D was charged with and convicted of first degree murder.
D appealed; her coconspirator had abandoned the conspiracy and the death of her husband was
from self-defense.
