NATURE OF THE CASE: This was an appeal from a conviction for kidnapping and for murder in the first degree.
FACTS: Zimmer (D) kidnapped and murdered a child. The place of the murder was never established at trial. The abduction was committed in Shawnee County. The victim's body was found in Pottawatomie County. D was tried and convicted of felony murder. D appealed. D contends that the prosecution had never established Shawnee as the proper place to hold the trial and that there was no evidence that the killing occurred there. D also contends that the prosecution did not prove that the victim was confined against her will. A state law provided that kidnapping may be tried in any county into or through which the victim was brought and that a public offense committed partly in one county may be tried in either county.
