NATURE OF THE CASE: Belleville (P), a corporation and its guarantors, sued Champaign (D) invoking diversity jurisdiction pursuant to 28 U.S.C.S. 1332. D counterclaimed. A jury trial was held ending in a verdict of $220,000 in D's favor on the counterclaim. P appealed.
FACTS: Invoking the diversity jurisdiction, see 28 U.S.C. 1332, the complaint alleged that P is incorporated in Missouri and has its principal place of business there, and that the five individual plaintiffs are citizens of Missouri. It alleged that D is a 'Delaware Limited Liability Company, with its principle [sic] place of business in the State of Illinois.' D agreed with these allegations and filed a counterclaim. The magistrate judge accepted these jurisdictional allegations at face value. A jury trial was held, ending in a verdict of $220,000 in D's favor on the counterclaim. Ps appealed.
