BROYLES V. COMMONWEALTH 267 S.W.2d 73 (1954) CASE BRIEF

BROYLES V. COMMONWEALTH
267 S.W.2d 73 (1954)
NATURE OF THE CASE: This was an appeal from a murder conviction and life sentence.
FACTS: Broyles (D) was charged with the murder of Billy D. Smithers. During trial D introduced several witnesses who testified that his reputation for peace and quietude was good. On cross the prosecution then asked each of the witnesses if they knew that D had been arrested and convicted on separate occasions for drunk driving, reckless driving, and disorderly conduct. D objected and contends that these questions were improper for cross-examination because they related to a character trait not involved in the crime of murder. D was convicted and appealed.
