NATURE OF THE CASE: Cilek (D) appealed a judgment, which denied D's motion for summary judgment on Strauss' (P), husband's, claim of intentional infliction of emotional distress arising from D's romantic and sexual relationship with P's wife.
FACTS: P and D were friends. D's affair with P's wife lasted one year. P learned about the affair when it was over. P and his wife were in the process of obtaining a divorce at the time P sued D for actual and punitive damages. The court overruled D's motion for summary judgment.
