NATURE OF THE CASE: Kaiserman (D) appealed from a judgment of copyright infringement.
FACTS: Gaste (P), a resident and citizen of France, composed the music to a song entitled 'Pour Toi.' P registered the sheet music for the song in the United States Copyright Office in 1957. In 1973, D composed and recorded the song 'Feelings.' 'Feelings' became a smash hit internationally, winning 'gold records' in a number of countries.
