NATURE OF THE CASE: This was an appeal from a decree entered by the Court.
FACTS: A decree was issued that found that fraud had been committed against Rauth by Papierz (D) and others. The decree is listed on pages 311 to 313 Re 5th edition. After ordering the accounting the trial judge appointed an accounting firm to determine the net sums due and also appointed a receiver. D appealed in that the appointment of a firm to do the accounting was contrary to Illinois law and he also appealed the appointment of the receiver.
