NATURE OF THE CASE: This was a personal injury suit.
FACTS: Thompson furnished an automobile to his estranged wife Geraldine who entrusted the car to a Nancy Carder. Plaintiff, a passenger in the car driven by Carder, was injured when the car skidded on a wet pavement. P sued Carder and the Thompsons and was nonsuited. During trial, the issue was whether notice had been put upon the Thompsons or Carder that the car needed new tires. As part of the evidence there were statements concerning what a sticker inspector told Carder and Mrs. Thompson and there was also an incident at a filling station with Carder and Mrs. Thompson about the need for new tires.
