NATURE OF THE CASE: This was a dispute over spousal testimony.
FACTS: Estes (D) worked for Purolater as a driver-guard. One day he decided to invest in
his own future and took $55,000 and returned home with the cash. D's wife Lydia was quickly
informed of his new found wealth and they hid some of the money and spent the rest. D's wife
helped hide and launder the money. D and Lydia were then divorced and eventually Lydia
contacted the FBI and obtained a grant of immunity for herself and got tapes on D. Lydia
testified before the grand jury and at D's trial. D was convicted of perjury and appealed.
