UNITED STATES V. PACELLI
491 F.2d 1108, cert. denied 419 U.S. 826 (2nd Cir. 1974)
NATURE OF THE CASE: This was an appeal from a conviction of conspiracy to interfere with
the civil rights of another. Pacelli (D) challenged a judgment that convicted him of
conspiracy to deprive a victim of her civil rights, causing her death, 18 U.S.C.S. 241,
and injuring the victim, 18 U.S.C.S. 1503.
FACTS: Patsy Parks was scheduled to appear before a federal grand jury and federal agents
tried to subpoena her. She had previously testified before a grand jury regarding drug
dealing about a box containing money that was delivered to Pacelli (D). She was found the
next day brutally stabbed and doused with gasoline and set afire in a desolate area of Long
Island. The grand jury indicted D and others and alleged that D killed Parks to keep her
from testifying. D was convicted and appealed on the admission of testimony.
