NATURE OF THE CASE: This was a dispute over the use of a less than unanimous jury verdict for conviction.
FACTS: Johnson (D) was tried for robbery before a 12-man jury. The verdict was 9 to 3 and this conviction verdict was allowed under Louisiana law. D appealed this conviction in that guilt could not be determined to be beyond a reasonable doubt when one or more of a jury still possess that doubt.
