NATURE OF THE CASE: This was a dispute over eligibility for food stamps.
FACTS: In 1981 Congress amended the food stamp program to provide that no household shall
become eligible to receive food stamps while any one of its members is on strike. This was a
challenge to that amendment. The appeals court declared the amendment unconstitutional on
three different grounds; First Amendment and Equal Protection.
