NATURE OF THE CASE: This was a criminal prosecution for murder.
FACTS: Burrows (D), a teenager, was picked up while hitchhiking by Martin. Martin told D to drink or he would put him out of the car. D had never tasted alcohol. D drank because he had no money and feared being left alone in the desert. D became drunk and shot Martin. D did not realize what he had done until afterwards. D testified at his trial that the deceased vehemently urged him to drink intoxicating liquor. D asserted involuntary intoxication at trial. D was convicted of murder and appealed.
