NATURE OF THE CASE: This was a dispute over age discrimination.
FACTS: The Missouri Constitution required that all judges other than municipal judges must retire at 70 years of age. Two judges challenged this provision as violative of the ADEA; which made it unlawful for an employer to discharge any individual who is 40 years old because of that individual's age.
