NATURE OF THE CASE: This was an action over a mechanic's lien.
FACTS: Campbell (P) expended labor and materials in the improvement of Murdock's (D) land pursuant to a contract between P and McMahon, the duly authorized agent of D. P is a resident of Pennsylvania. D is a resident of South Carolina. McMahon is a resident of Ohio. P sued D and D appeared for the purpose of challenging jurisdiction. D moved to dismiss the action in so far as it asks for a personal judgment and appeared only to defend her interest in the property. Section 1655 provided that in actions to enforce liens if the defendant is ordered to appear and does not the final judgment can only affect the property subject to the action. D claims that this section does not allow personal judgment against her if she does appear.
