NATURE OF THE CASE: This was a wrongful death action.
FACTS: Cruzan (P) was killed while he came down a ladder on the side of a railroad car. P was struck by a locomotive. P sued under FELA to recover. The Trial judge refused to rule that there was no negligence and the verdict went to P and D appealed.
