NATURE OF THE CASE: This case questioned the validity of Rules 35 and 37
FACTS: Sibbach (P) brought an action for bodily injury against Wilson (D). P sued in Illinois District Court for damages suffered in an accident in Indiana. D denied the charges and asked for a court order for P to submit to a physical examination in accordance with Rule 35. It was ordered and P refused. D asked for contempt and it was granted. P claimed that Indiana does not allow such an order and appealed. The court of appeals affirmed the Rule 35 order for a physical examination. It was submitted for review to the Supreme Court.
