NATURE OF THE CASE: This was a personal injury action.
FACTS: A car driven by Simblest (P) collided with a fire engine driven by Maynard (D). The testimony given at trial was in hopeless conflict. At the close of evidence, D moved for a directed verdict and it was denied. The jury found for P and the judge granted a judgment n.o.v. P appealed.
