NATURE OF THE CASE: This case discusses the Separation of Powers doctrine in relationship to the responsibilities of the Executive and Legislative branches during war time.
FACTS: Upon President Lincoln's order, southern ports were blockaded and as a result, ships, property, and people were intercepted by Union soldiers. At this time, Congress had pre-approved all actions by the President in emergency situations.
