NATURE OF THE CASE: This was a case involving rape and the sexual behavior and habits of the prosecutrix.
FACTS: The trial court held that the evidence concerning the past sexual behavior and habits of the prosecutrix was admissible in the rape trial of Black. (See page 332 of the casebook for the types of conduct the victim engaged in). This ruling was made pursuant to rule 412 of the Federal Rules of Evidence. The victim appealed the trial court ruling.
