NATURE OF THE CASE: This was a second appeal resulting from a retrial and second conviction of statutory rape.
FACTS: Azure (D) was charged with carnal knowledge of a 10-year-old girl. D was convicted but that conviction was overturned and a retrial occurred. During the retrial, the court refused to admit evidence of the girl's past sexual behavior and the court admitted an out of court statement of a social worker identifying D as the individual who abused her and admitting excerpts from D's prior sworn testimony. D was convicted and appealed.
