NATURE OF THE CASE: This was a personal injury action and the bad faith of the insurance carrier.
FACTS: P sued his insurance company for bad faith and negligence in failing to settle two cases against P. P filed a production of documents request for all correspondence relating to the two cases and D responded on grounds that the information was privileged. The court found that the lawyers during the trial represented both parties and found that he documents were not privileged. D appealed.
