NATURE OF THE CASE: This was an appeal from a murder trial and the use of privileged testimony.
FACTS: Mrs. Pratt shot her husband but claimed insanity. During trial, the state called as a witness a psychiatrist that D had used in preparation for trial. D objected under the attorney client privilege. D was convicted and appealed.
