NATURE OF THE CASE: This was a motion to vacate decision from a Patent case.
FACTS: The moving parties had appealed from a judgment dismissing their complaint brought under Section 1495, R.S., 35 U.S.C.A. Section 63, to require the Patent Office to grant patents on certain claims relating to an automatic stock quotation board. The court affirmed the order of the court below and dismissed the complaint. During that process, the court raised and decided a question sua sponte and based its opinion on facts found in investigations authorized by Congress.
