NATURE OF THE CASE: This was a case involving a protective order and a denial of it.
FACTS: Kalinauskas (P) sued Caesars Palace Hotel & Casino for sexual harassment. P wanted to depose another former employee of Caesars who had filed a sexual harassment suit. Caesars opposed that deposition because that suit had been settled by a Protective Order and it was under a confidential order that the plaintiff (the former employee) shall not discuss any aspect of her employment at Caesars other than the dates of her employment and her job title. D sought a protective order to prevent the deposition of the former employee. The court was asked to resolve the competing interests.
