NATURE OF THE CASE: This was a dispute over the Presidential Recordings and Materials Preservation Act.
FACTS: The Act required the General Services Administrator to take custody of Presidential Papers and tape recordings of Nixon and promulgate regulations that provide for the orderly processing and screening of the materials for the purpose of returning those that are private in nature and then to determine when public access to all the materials will be granted. Nixon (P) disputed the Act as a violation of separation of powers, Presidential privilege, privacy interests, First Amendment rights and as a Bill of Attainder.
