BLOCK V. COMMUNITY NUTRITION INSTITUTE 467 U.S. 340 (1984) CASE BRIEF

BLOCK V. COMMUNITY NUTRITION INSTITUTE
467 U.S. 340 (1984)
NATURE OF THE CASE: This was a dispute over milk pricing. Block (D) appealed from an appellate affirmation of reviewability in Community’s (P) petition for judicial review of agency rulemaking.
FACTS: The Agricultural Marketing Act of 1937 set the minimum prices milk handlers must pay to producers for milk. Consumers and nonprofit organizations promoting better nutrition for lower income families challenged the Secretary's decision that the higher price of milk processed for drinking applied to reconstituted milk. They argued that this pricing structure made reconstituted milk uneconomical for handlers to process and thus deprived consumers of a less expensive source of milk.
